’-I Interesting Decision .—^The circuit court of jhe United States, justices Story and Pitman, at their recent session in Newport, decided that a general Assignee of an insolvent debtor, took the estate. Subject to all pre-existing liens, or in other words, that he stood in the shoes of the assignor. The question arose in the case of pavid Wilkinson vs. Church Gray. Gray was the general assignee of a Mr. Pliss under what )3 called an out door assignment. The counsel for the defendant contended that if a debtor mortgages bis real estate, and afterwards and before the mortgage is recorded, makes an as signment for the benefit of all his creditors; and the assignee has no notice of the unrecorded mortgage, that it shall prevail against it, it be- jjig for the benefit of creditors; and for this he relied upon the case of Dey vs. Dunham, 2 Johnston’s Ch. Rep. 182, in which Chancellor Kent fully established the doctrine. It was contended on the other side that the authority relied upon by Chancellor Kent, the case of gievenson vs. Hayward, Free, in Chan. 310, did not warrant such a doctrine. Justices ^ Story and Pitnam both express a decided opinion, that the assignee stands in the shoes of the Assignor; that he takes the pro perty loaded with all liens, mortgages and in cumbrances which existed at the time of the assignment, and that such incumbrances, though unrecorded,yet being good against the Assignee. ^Bost. To merchants, whose business requires a short and certain passage for their merchandize, and to others who may want to transport to the New-YorK market, Horses, Cattle, Hogs, Sheep, &c. or the various kinds of market stuff, such as Butter, Cheese, Fruit, &c, &c. the advantages of such an arrangement must be evident.
